These accidents happen when a vehicle makes a right turn from a wide lane and collides with a vehicle that is trying to pass on the right.
In this diagram, Vehicle B is making a right turn in a wide lane when it collides with Vehicle A, which is passing on the right.
Vehicle "A" = 75%
Vehicle "B" = 25%
The rules of the road
Drivers must make right turns close to the right hand curb or edge of the roadway and must not pass (overtake) on the right of another vehicle. Therefore, Vehicle A would be 75% responsible and Vehicle B would be 25% responsible.
